29 CFR 1910.176(b): Material stored in tiers was not stacked, blocked,
interlocked or limited
in height so that it was stable and secure against sliding and collapse:
On or about December 06,2006 and times prior thereto, the employer did not
ensure that stacks
of pallets on the upper level mezzanine were blocked so that they were
stable and secure against
sliding and collapse.
In the alternative:
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish
to each of his employees employment and a place of employment which were
free from
recognized hazards that were causing or likely to cause death or serious
physical harm to
employees in that employees were exposed to a crushed-by hazard:
On or about December 06, 2005, and times prior thereto, the employer did
not
ensure that stacks
of pallets on the upper level mezzanine pallet return system were
restrained from falling from
the mezzanine level to the next lower level.
Among other methods, one feasible and acceptable means to abate this
hazard is to install
devices, such as but not limited to, poles, guardrails, and backstops at
the end of the pallet
return in accordance with American National Standard Institute (ANSI)
B20.1, Safety Standard
for Conveyors and Related Equipment.
