Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to: (a) Hazard of being caught in moving parts of a Ditch Witch Tractor Model 5110 Two Post SN 5N0584 when on or about June 5, 2006, on the construction site located at 2832 El Dorado, Litte Elm, Texas, employees operating the ditch witch and working directly above the digging teeth were exposed to being caught. Among other methods, one feasible and acceptable method to correct this hazard is to follow the instructions in the tractor Operator's Manual. (1) Keep everyone at least 6 feet from machine and attachments; (2) Allow 3 feet between end of boom and obstacle, (b) Hazard of being struck by Ditch Witch Tractor Model 5110 Two Post SN 5N0584 when on or about June 6, 2006, at the construction site, located at 2832 E. El Dorado Parkway, Little Elm, Texas, the Operator Present device was
