Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to the hazard of being struck by a hydraulic vehicle lift:
a) On or about March 1, 2005, the employer failed to ensure the safety of
the employee(s) in
that the locking devices on the hydraulic lift number two, located in the
shop was not functioning
properly. The safety latch cable was broken so only the latch on the
operators side was working.
The latch on the other side was disabled, secured back with a wire.
b) On or about March 1, 2005, the employer failed to ensure the safety of
the
employee(s) in
that the locking devices on the hydraulic lift number five, located in the
shop was not
functioning properly. The safety latch cable was broken so only the latch
on the operators side
was working. The latch on the other side was disabled, secured back with a
bolt.
c) On or about March 1, 2005, the employer failed to ensure the safety of
the employee(s) in
that the on/off switch on the hydraulic lift number six, located in the
shop was not functioning
properly. The on/off switch was broken and bi-passed so that the lift
would operate by using the
main disconnect switch.
Among other methods, one feasible and acceptable abatement method to
correct this hazard is
to follow ANSI/ALOIM-2000, (Operator Reporting) Section 4.5, (Inspection
Points), Section
5.6.2.10, and Section 5.6.2.16.
No abatement certification or documentation is required for this item.

a) The employer failed to conduct daily and periodic inspection on the
Rotary lifts #1 through
#6.
Among other methods, one feasible and acceptable abatement method to
correct this hazard is
to follow ANSI/ALOIM-2000, (Qualified Inspection Procedures), Section 5.1,
and (Operator
Responsibilities), Section 4.4.4.
In accordance with 29 CFR 1903.19(d), abatement certification is required
for this violation
(using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in
addition, documentation demonstrating that the abatement is complete must
be included
with your certification. This documentation may include, but is not
limited
to, evidence of
the purchase or repair of the equipment, photographic or video evidence of
abatement, or
other written records.
