Section 5(a)(1) of the Occupational Safety and Health Act of 1970 : The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to fragmentation of a chop saw wheel.
a)At the construction site, 970 Kent Avenue, Brooklyn, NY
On or about April 19, 2005
A DeWalt DW8003 cop saw wheel was being used at a higher rated speed then
it was rated for and it was used on a portable tool it was not designed to
be used
with.
ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHODS, AMONG OTHERS, TO
CORRECT THIS HAZARD IS:
1) Follow the ANSI B7.1-2000 requirements of section 4.1-4.2, 7.1-7.2,
E8.5 and E9.1.
Section 4.1 Abrasive wheels shall be used only on machines provided with
safety guards.
Section 4.2 A safety guard for Type 1 wheel shall enclose the top and both
sides of the grinding
wheel and at least 180 degrees of the wheel.
Section 7.1-7.2 Abrasive wheels shall show maximum operating speed as RPM.
... The user
shall establish a program to ensure that grinding machines do not subject
abrasive wheels to
speeds greater that the maximum operating speeds marked on the wheel or
package.
Section E8.5 Under no condition should a wheel be operated faster than the
maximum operating
speed established by the manufacturer.
Section E9.1 ... the user insists that only personnel with mechanical
aptitude and good
knowledge of the contents of this Standard be assigned to the mounting,
care, inspection, and
operation of abrasive wheels and grinding machines.
2) Follow the instructions provided by the manufacturer of the Chop Saw
Blade.
DeWalt identifies the DW80003 Chop Saw Blade to be used only on Cut Off
Saws and not
portable grinders.
NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION
FOR THIS ITEM IN ACCORDANCE WITH 29 CFR 1903.19.CE
