Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that the
employees were exposed to falling down the elevator shaft or being crushed
by moving elevator.
a)Elevator shaft doors on the 1st floor and basement.
The elevator shaft doors did not latch closed when the elevator was not on
those
floors, causing employees to be exposed to falls of up to approximately 14
feet
to bottom of shaft below, or being crushed by moving elevator and
stationary
shaft walls, on or about 4/19/05 and the 6 months preceding.
ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD, AMONG OTHERS, TO
CORRECT THIS HAZARD IS: to follow ASME A 17.3-1993 Safety Code for Existing
Elevators. Section 2.7.4 "Restricted Opening of Hoistway Doors" which
states
that the hoistway
door shall prevent the opening of the door when the elevator is not in the
landing zone.
NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION
AND DOCUMENTATION FOR THIS ITEM IN ACCORDANCE WITH 29 CFR 1903.19NCE
