Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of: (a) Location - external chemical fill station On or about February 10, 2005, the employer did not have a set procedure or policy in place for ensuring that hoses from the chemical delivery trucks are connected to the correct chemical storage tanks. A feasible means of abatement would be for the employer to implement a procedure or policy that would ensure that an employee/technician from Earth Tech double-check the hose connections between the chemical delivery truck and storage tanks prior to the initiation of filling the tanks. Another feasible means of abatement would be for the employer to lock the quick-connect caps to the tanks so that a chemical delivery driver cannot open the caps themselves.ct
