Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards of falling: a) Location- 55th Street and Northern Avenue, Plum Island, MA: On or about February 2, 2005, an employee was exposed to a fall of approximately 14 feet while being lifted by the bucket of a Komatsu PC200LC excavator to repair a disconnected cable. Among other methods, feasible means of abatement would be: 1) Use the repair technician services of the local electrical, cable, and telephone service provider when needed who have the properly trained and authorized personnel using personnel lifts. 2) Use of an appropriately designed personnel lift by a trained and authorized operator and repair service technician.
