Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not
furnish to each of his employees employment and a place of employment
which were free
from recognized hazards that were causing or likely to cause death or
serious physical harm
to employees in that employees were exposed laceration injuries from a
hand held electric
grinder, 6000 rpm:
Location: 121 W 19th St, New York, N.Y.
On or about 04/15/05.
The employer field modified the Bosch model 1752G7 angle grinder using
incorrect
replacement parts. The following instances were observed:
a)The original side handle of the grinder was replaced with a piece of
threaded metal
rod which does not have the equivalent gripping surface and shape to
employees the
maximum ability to control the 6000 rpm tool during use.
Additionally the metal rod has no rubber insulation resulting in electric
shock hazard.
b)The original backing flange and lock nut for the blade were replaced by
a simple store
bought nut and washer which allowed for the blade to be installed but
caused the
blade guard not to fit on the tool.
AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT
METHOD TO CORRECT THIS HAZARD IS:
Refer to the Bosch "Operating / Safety Instructions" manual and comply
with the Angle
Grinder Safety Rules which state, pg 3, "Always use auxiliary handle for
maximum control
of torque reaction and kick-back".
And comply with the Service instructions in the same manual which state,
pg 3, "When
servicing a tool, use only identical replacement parts. Use of
unauthorized parts... may
create a risk of electric shock or injury".
Note:  The employer is required to submit abatement certification for this
item in accordance
with 29  CFR 1903.19.
