Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that the
employees were exposed to being crushed by moving backhoe while removing
boom attachments
on unleveled ground.
a)On site.
Employees working on removing boom attachments from an Hitachi EX-750 back
hoe.
Was not protected from the hazard of unleveled unstable footing, on or
about 6/22/05.
ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD, AMONG OTHERS, TO
CORRECT THIS HAZARD IS: to follow the manufacturer`s manual, "Precautions
for
Assembly" Page 6-1, paragraph 5. "Check the footing is strong enough to
support the machine
weight.  If required, repair the footing sufficiently so that the machine
can be kept in a
horizontal position".
NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION
AND DOCUMENTATION FOR THIS ITEM IN ACCORDANCE WITH 29 CFR 1903.19NCE
