Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing hazards associated with failing to properly use seatbelt restraint devices while operating powered industrial trucks (JLG Lull lift). Jobsite located at 10608 Sapp Bros., Drive, Omaha, NE 68138-Employees who operate powered industrial trucks at the facility were not properly trained to wear seatbelt restraint devices while operating powered industrial trucks such as the JLG Lull lift, and seatbelt restraint devices were not being used. AMONG METHODS AND ACCEPTABLE ABATEMENT METHODS TO CORRECT THIS HAZARD IS: (A) Ensure that employees who are required to operate equipment such as but not limited to the JLG Lull lift are trained to use the seatbelt restraint device. (B) Enforce company policy and equipment operation manual requirements for the wearing of seatbelt restraints. Abatement certification and abatement documentation is required for this violation. The documentation should include written verification of abatement, applicable measurements or monitoring results, and photographs or videos which you believe will be helpful. Abatement certification sheet is enclosed with the citation.
