Section 5(a)(1) of the Occupational Safety and Health Act of 1970: Sidney Warehouse LLC- 2321 Industrial Rd, Sidney NE - The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of falls while being elevated on the forks of a powered industrial trucks without adequate means of fall protection. An employee, who was elevated by a platform on the forks of an industrial truck, was guiding drivers of the other forklifts to assist in the unloading of steel pipes from the railroad car. The guardrail system on the platform did not have a midrail as referenced in ASME B56.1-2000 paragraph 7.36.1(d)(1). Among other methods, one feasible and acceptable method to correct this hazard includes, but is not limited to the following: i)Provide a work platform following the protection outlined in ASME Standard B56.1-2000 paragraph 4.17.3 which includes that platform complies with the design requirements in the paragraph 7.36. ii)Implements the precautions for using an industrial truck to elevate personnel as outlined in ASME Standard B56.1-2000 paragraph 4.17.2 iii)Develop and implement written procedures for the safe elevation of personnel using powered industrial trucks per ASME B56.1-2000. Abatement certification is required for this violation. The abatement certification sheet is enclosed with the citations.ion
