Secton 5(a)(1) of the Occupational Safety and Health Act of 1970:
Midwest Construction Services, Inc. - Offutt Air Force Base - The employer
did not furnish
employment and a place of employment which were free from recognized
hazards that were
causing or likely to cause death or serious physical harm to employees in
that: Employees were
exposed to the hazards of death or serious physical harm during vehicle
accidents and vehicle
ejection when traveling without passenger restraint in the cargo area and
passenger cab of a
rental truck.
On October 3, 2006, a subcontracted employee riding in the back cargo area
of a rental truck
fell out and suffered fatal head injuries on the flightline at Offutt Air
Force Base.
Feasible means of abatement may include but are not limited to the
following:
1) Prohibit employees from riding in the cargo/non-passenger areas of work
vehicles
as
outlined in the Vehicle Safety section of the Offutt Air Force Base
Contractor Briefing
Form.
2) Develop and implement written procedures to ensure the use of passenger
restraint
devices for all type of employee vehicular travel as mandated in the
Vehicle Safety
section of the Offutt Air Force Base Contractor Briefing Form.
Abatement certification and abatement documentation is required for this
violation. The
documentation should include written verification of abatement, applicable
measurements or
monitoring results, and photographs or videos which you believe will be
helpful. The abatement
certification sheet is enclosed with the citations.ion
