Section 5(a)(1) of the Occupational Safety and Health Act of 1970:
Facility located at Highway 75 North P.O. Box 260, Herman, NE - The
employer is not
furnishing employment and a place of employment which are free from
recognized
hazards that are causing or are likely to cause death or serious harm to
employees in that
employees are exposed to the hazards of being struck by, crushed by or
thrown from a
powered industrial truck (forklift) in the event the operator is not
restrained while
operating these vehicles.
The operators in this facility have been observed operating forklifts
without using the
seatbelts which are provided on the vehicles.  Employees face the
potential of being
thrown from a fork lift due to the lack of restraint device usage being
observed at the
plant.
Among other methods, feasible and acceptable methods of abatement are:
1)  Develop and implement written procedures as per ASME Standard
B56.1-2000,
requiring operators of powered industrial trucks to utilize restraint
devices provided when
operating the vehicles.
2)  Develop and implement a disciplinary action and procedures to ensure
that employees
wear restraint devices while operating these vehicles.
3)  Review and audit the company's training program and trainers to ensure
that
information being presented is true and factual as per the latest
regulatory directives and
reflects OSHA policy and generally accepted industry practices such as
ASME Standard
B56.1-2000.
4)  Ensure that all operators have received a certified powered industrial
truck training
course prior to them being allowed to operate the vehicles in the
facility.
This training
should meet or exceed the requirements of 29 CFR 1910.178(l)(3).
Abatement certification and abatement documentation is required for this
violation. The
documentation should include written verification of abatement, applicable
measurements
or monitoring results, and photographs or videos which you believe will be
helpful. The
abatement certification sheet is enclosed with the citations.ion
