Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: Struck by Hazards: On February 24, 2005, the worksite foreman was observed driving a backhoe/loader up a grade carrying a trenchbox as its load, which obstructed his view of travel. At the crest of the grade, an employee was observed standing in the roadway performing flagging operations. The flagger was exposed to being struck by the backhoew/loader. The Equipment Manufacturers Institute's publication: Backhoe/Loader Safety Manual for Operators and Mechanics covers under "Traveling On Jobsite" a warning which states "Don't obstruct your vision when traveling or working." It also states under "Loader Safety Precautions " that the operator should "Avoid steep slopes or unstable surfaces. If you must drive on a slope, keep the load low and proceed with extreme caution." A feasible means of abatement would have been to follow the guidelines of the EMI Manual where it states "Don't obstruct your vision when traveling or working."

Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: Struck By and Caught Between Injuries: On February 24, 2005, An employee was observed riding on the frame of a backhoe while it was in operation (traveling). The employee was exposed to falls, struck bys and caught betweens by the backhoe/loader while traveling. The Equipment Manufacturers Institute's publication: Backhoe/Loader, Safety Manual for Operators and Mechanics denotes a warning under the "Work Safely" section which states that "Your backhoe/loader is a one person machine. Never Permit Riders." A feasible means of abatement would have been to follow the guidelines set forth in the EMI Manual, which states "Your backhoe/loader is a one person machine. Never Permit Riders."
