employment and a place of
employment which was free from recognized hazards that were causing or
likely to cause death
or serious physical harm to employees:
The employer failed to ensure fall protection was used as follows:
a.On the North side of the casino, an employee was trimming trees in an
Ahern
boom lift, serial #23663, approximatelty 15 feet high, and was not wearing
a full
body harness with a lanyard attached to an approved anchorage point.  He
had a
body belt on that was tied off to the frame of the boom lift with a rope.

Section 7.3.3 Pre-Start Inspection:  Before use each day or at the
beginning of
each shift, the aerial platform shall be given a visual inspection and
functional test
including but not limited to the following: (c) Personal protection
devices,
including fall protection.
Section 8.8 During Operation:  The aerial platform shall be used in
accordance
with this standard.  The operator shall ensure the following before each
elevation
of the platform: (g) Ensure all personnel in the platform are wearing fall
protection devices and other safety gear as required at all times.
One feasible means of abatement is to make sure that the proper personnel
fall
protection equipment required to do the job is provided and utilized.
