North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to falling loads when opening the tailgate: a)on 2/12/05, an employee of CBC Custom Shoreline, Inc. was delivering a load of large rocks to a jobsite. The employee was struck on the leg by a large rock while manually opening the tailgate. No procedure or control method was utilized to ensure employees do not stand or walk-through an area where an upset load might fall. NOTE: Among other methods, one feasible and acceptable method to abate this hazard is to develop a procedure and provide employee training to ensure all tailgate opening operations comply with Ox Bodies Service and Parts Manual which states, "When operating DO NOT allow anyone to stand in or move through the area where the hoist operates, or into an area where an upset load might fall."
