T.C.A 50-3-105(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: In that the employer did not ensure that forklift operators in the dock area utilized seatbelts to prevent being crushed in the event of a forklift tip-over. Among other methods, one feasible and acceptable abatement method to correct this hazard is to advise employees to wear seat belts while in the dock area and to enforce this policy.
