Section 5(a)(1) of the Occupational Safety and Health Act of 1970:
The employer did not furnish employment and a place of employment which
were free from
recognized hazards that were causing or likely to cause death or serious
physical harm to
employees in that employees were exposed to the hazards associated with
unauthorized rider(s)
on a fork lift:
a)  Front of building - Four employees were riding on a pallet carried on
the forks of a Terex
TH 644C (a rough-terrain, powered industrial truck) to gain access to and
egress from the roof
with an elevation of approximately 17 feet.  In addition to the four
employees, the pallet also
contained three step ladders, a cooler and a tool box.
One means of feasible abatement, among others, would be to follow the
manufacturer's
guidelines for lifting personnel, if allowed, and American National
Standards Institute (ANSI)
Standard B56.6, Safety Standard for Rough Terrain Forklift Trucks, Section
5.15.1,
to provide
a personnel platform which complies with the design requirements listed in
part III (Section 825,
Platform for Elevating Personnel) of this standard.
