Section 5(a)(1) of the Occupational Safety and Health Act of 1970:
The employer did not furnish employment and a place of employment which
were free from
recognized hazards that were causing or likely to cause death or serious
physical harm to
employees in that an employee was exposed to the hazards associated with
unauthorized rider(s)
on a fork lift:
a)  West side of building - An employee was riding on a pallet carried on
the forks of a Terex
rough-terrain, powered industrial truck to reach work areas on the side of
the building, at heights
up to 25 feet.  The employee was protected from falls by the use of a
safety harness and
lanyard, but the industrial truck had a decal posted on it stating to not
lift personnel even with
a safety cage.
One means of feasible abatement, among others, would be to use equipment
which is designed
for lifting personnel and to follow that manufacturer's guidelines.r's
