Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that:
On or about 04/12/05, employees were exposed to being caught between
trees, limbs, and/or
fixed structures or being struck by trees or limbs while engaged in
removing and trimming trees,
limbs, etc., where tree(s) or components thereof were under stress or
tension due to pressure
or weight of another object, tree or limb.
Among other methods, feasible and acceptable means for abating this
condition include:
establishing and implementing work procedures which consider and address
all tree and site
factors prior to the start of any tree removal, trimming or related work
and performing adequate
visual inspections and ensuring appropriate cutting techniques are devised
and
followed  prior
to climbing or positioning workers in the danger zone of any tree, segment
of a tree, limb or
sapling under pressure or tension by any object in accordance with the
American National
Standards Institute (ANSI) Safety Requirements for Arboricultural
Operations for Pruning,
Repairing, Maintaining and Removing Trees, and Cutting Brush, Z133.1-2000.
