Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death of serious physical harm to employees in that employees were exposed to falls to pavement while being transported in the cargo area of a pickup truck: On March 29, 2005, two employees were riding in the cargo area of a Ford F150 XL pickup truck exposing employees to falls to pavement. Feasible means of abatement include, but are not limited to: a) Follow the guidelines established in the vehicle operations manual when transporting passengers: "It is extremely dangerous to ride in a cargo area of a vehicle. In a collision, people riding in these areas are more likely to be seriously injured or killed. Do not allow people to ride in any area of your vehicle that is not equipped with seats and safety belts. Be sure everyone in your vehicle is in a seat and using a safety belt properly." b) Transport employees in accordance with the National Highway Traffic Safety Administration. Their recommendations state in relevant portions: "Allow passengers to ride only in seating areas equipped with safety belts....Prohibit all passengers from riding in the cargo areas of pickup trucks."
