Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: At the worksite, the Caterpillar V40B powered industrial truck (forklift) was not equipped with a seat belt, exposing employees to the hazard of being struck by the forklift in the event of a tip-over accident. Employees operated the forklift in the saw mill yard, performing job operations such as but not limited to loading flat bed trailers with lumber products.
