and a place of employment which
were free of recognized hazards that were causing, or likely to cause
death or serious physical harm to
employees in that: Employee was exposed to struck by hazards while
operating a Haulotte HB76J telescopic
boom lift, when the basket was raised in upward direction of steel beam
and the operator's neck became
wedged  between basket railing and beam causing fatal injury.
One feasible, and acceptable abatement method among others to correct this
hazard is to comply with the safety
manual, which is included with operators manual and located with equipment
that states: When driving
machine or positioning the platform, keep all body parts inside the
platform railing. This same warning is
listed on machine decal located at operators control under the heading
Crushing Hazard.
In addition the manual also warns of the following: Always check clearance
above, below, and on all sides
before raising, lowering, or rotating the platform... Failure to do so
could
cause severe injury or death to
yourself and/or others.
