Section 5(a)(1) of Public Law 91-596, the Occupational Safety and Health
Act of 1970:  The
employer did not furnish employment and a place of employment which were
free from
recognized hazards that were causing or likely to cause death or serious
physical harm to
employees, in that employees were exposed to: being crushed due to not
wearing seat belts while
operating powered industrial truck(s) with rollover protective structures.
(a)Production Area - On May 17, 2005, operators of the following two
powered
industrial trucks, which were equipped with seatbelts/operator restraint
systems, were
operating these lifts while not wearing their seatbelts:
1. Caterpillar #39,
2. Caterpillar #38,
(b)Shipping Area - On May 17, 2005, the operator(s) of the following
powered
open shipping bays and turning over due to the absence of a restraint:
3. Caterpillar #29.
Among other methods, one feasible and acceptable abatement method to
correct this hazard is
for the employer to (1) enforce the wearing of seat belts among all
Powered Industrial Truck
Operators, and (2) retro-fit all powered industrial trucks which have
overhead protective
structures with seat belts.
