Section 5(a)(1) of Public Law 91-596, the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to: hazard of being struck by trailer when truck is traveling in reverse to the loading dock. (a)Loading Dock - On May 19, 2005 employees were exposed to being struck by trailer when truck is traveling in reverse to the loading dock. Trucks backing into loading dock did not have an observer, spotter or reverse signal alarm. Among other methods, one feasible and acceptable method to correct this hazard is: use a spotter to safely direct the truck and trailer into the loading dock.
