Section 5(a)(1) of Public Law 91-596, the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to: death by crushing due to the employer's failure to ensure that employees who operate material handling equipment, fitted with Roll-Over Protective Structure(s), wear seat belts. (a)Tupelo Waste-water Treatment Plant, 2056 International Drive, just North of the jobsite office trailer - An employee was operating the Komatsu WA250 Loader #71826, fitted with a ROPS canopy and front fork attachments, and carrying ductile iron pipe, while not wearing the provided seat-belts. Among other methods, one feasible and acceptable abatement method to correct this hazard is for the employer to require and enforce the wearing of operator restraints, i.e., seat belts.
