Section 5(a)(1) of Public Law 91-596, the Occupational Safety and Health
Act of 1970:  The
employer did not furnish employment and a place of employment which were
free from
recognized hazards that were causing or likely to cause death or serious
physical harm to
employees, in that employees were exposed to hazard of falls:
(a)Employees were exposed to the hazard of falling from an improperly used
lader
while changing the letters on an advertizing sign located in the front of
the establishment.
Due to the presence of shrubs and landscaping timbers employees did not
fully extend
and lock the spreaders in place on a fiberglass stepladder.  The ladder
was leaned against
the sign and employees working near the top of the ladder were exposed to
the hazard
of falling approximately seven feet to the ground.
Among other methods, feasible and acceptable methods to abate this hazard
include the
following:  1) Instruct workers in proper ladder use as outlined in
manufacturers
instructions
printed on a label affixed to the frame of the ladder and as outlined in
ANSI A 14.5; 2) Develop
and implement written procedures that require workers to implement proper
ladder use; 3)
Develop and implement an inspection policy to verify and enforce
compliance with ANSI 14.5.
