Section 5(a)(1) of Public Law 91-596, the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to:being crushed by an overturned powered industrial truck. (a)On yard and inside the Block Plant Building - On or about July 26, 2006 employee(s) were operating the Hyster 60 LPG powered industrial truck while not wearing the operator's seat belt. Among other methods, one feasible and acceptable abatement method to correct this hazard is to require the wearing of operator restraint system belts anytime anyone operates a powered industrial truck.
