Section 5(a)(1) of Public Law 91-596, the Occupational Safety and Health
Act of 1970:  The
employer did not furnish employment and a place of employment which were
free from
recognized hazards that were causing or likely to cause death or serious
physical harm to
employees, in that employees were exposed to: falling from the moving
tractor-mounted box-
blade attachment, and being fatally injured.
(a)Northside Drive at Cascades Circle West workzone, Clinton, Mississippi
- On or
about September 8, 2006 at 12:35 PM, a Mississippi Paving & Construction,
Inc.
employee was observed riding atop the box-blade attachment mounted on the
rear of the
New Holland 345D Turbo-charged diesel tractor, which was being driven
passed the
street intersection mentioned above at a high rate of speed.
Among other methods, one feasible and acceptable abatement method to
correct this hazard is
to enforce a policy of not allowing any riders on moving equipment, except
for
authorized
employee(s).

compactor/roller with steel rollers due to the employee's failure to wear
a seatbelt.

- On or
about September 8, 2006, the Mississippi Paving & Construction, Inc.
employee
operating the steel wheeled Ingersoll-Rand DD-110 asphalt compactor/roller
was not
wearing the seatbelt provided on the machine.
Among other methods, one feasible and acceptable abatement method to
correct this hazard is
to require that equipment operators always wear the seatbelt provided.
