Section 5(a)(1) of Public Law 91-596, the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to a fall hazard. (a)Job site located at 321 Highway 90, Waveland, MS - On or about December 5, 2006 employees were being elevated on a platform by forks attached to the bucket of a DEERE 310E backhoe, thereby, exposing employees to a fall hazard. Among other methods, one feasible abatement method to correct this hazard is to keep all employees, riders and non equipment operators off the machine.
