Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to falls of 40 feet from the aerial lift due to carrying a load. (a)Comfort Inn - On or about June 2 to June 4, two employees were using a Genie S-80 aerial lift a load to the top of the elevator shaft causing a possible overload and causing an unbalanced condition. Among other methods, one feasible and acceptable abatement method is to lift materials with the rough terrain forklift that was on site. Among other methods, one feasible and acceptable abatement method is to train all operators of aerial lifts to not lift loads.
