Section 5(a)(1) of Public Law 91-596, the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that, employees were exposed to the hazard of being struck by or crushed by a 72 inch diameter concrete pipe being transported by Caterpillar wheel loader. (a)Bussell Avenue and 9th Street - On or about July 6, 2007 an employee was struck by a 72 inch diameter concrete pipe being transported by Caterpillar 938G Series II includes but not limited to: Install a work fork attachment designed to completely encircle 72 inch diameter concrete drain pipe.
