North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being struck by falling loads in weights of up to 600 pounds due to failure of lifting hook, (re paras 10-1.2.2 and 10-1.3 ASME B30.10-1993): a)work area-hook used for the lifting of truck drive train parts with weights of up to 600 pounds, to a table for work and repair, was not rated for the weights to be lifted was damaged by being bent and deformed. (re paras 10-1.2.2 and 10-1.3 ASME B30.10-1993): One feasible means of abatement is to use only hooks that are load rated for the weight to be lifted. or in the alternative: 29 CFR 1910.184(e)(2)(i): Hooks, rings, oblong links, pear shaped links, welded or mechanical coupling links or other attachments did not have a rated capacity at least equal to that of the alloy steel chain with which they are used.
