North Carolina General Statute 95-129(1) of the Occupational Safety and
Health Act of North Carolina:
The employer did not furnish each of his employees conditions of
employment and a place of employment free
from recognized hazards that were causing or likely to cause death or
serious physical harm to employees in
that employees were exposed to injury due to an unauthorized modification
of a baler machine as outlined in
the operators manual of a Philadelphia Tramrail Company baling machine:
a)stockroom/bailer area-the ejection chain of a Philadelphia Tramrail
Company vertical
downstroke baler had been broken and unauthorized modifications and
repairs had been made
with a padlock. Re: page 21 of the Parts and Service manual
One feasible means of abatement is to replace the broken chain with a new
authorized chain.ized
