North Carolina General Statute 95-129(1) of the Occupational Safety and
Health Act of North Carolina:  The
employer did not furnish each of his employees conditions of employment
and a place of employment free from
recognized hazards that were causing or likely to cause death or serious
physical harm to employees in that
employees were exposed to the hazards of contacting acids and corrosives
from leakage or spillage in areas where
there was insufficient lighting:
a)at the #1 containment area of the facility, where illumination was
measured with a light meter at
levels of 3.7 to 31.2 foot candles of light in and around the ground level
of the containment  where
sulfuric acid was stored.  On September 11, 2005, at approximately 04:15
am, an employee went
outside to perform routine inspection and adjustments of the diluter pump
and was discovered inside
the containment area on his hands and knees covered with 93sulfuric acid
as the result of a leak
from the diluter tank.
ABATEMENT NOTE:  Among other methods, one feasible and acceptable
abatement
method to
correct this hazard is to install lighting which is in accordance with
ANSI A11.l-1965 (R1970)
Industrial Lighting, Table 1, which lists the level of illumination
currently recommended for
ordinary inspection to be 50 foot candles.on
