North Carolina General Statute 95-129(1) of the Occupational Safety and
Health Act of North
Carolina:  The employer did not furnish to each of his employees
conditions of employment and a
place of employment which were free from recognized hazards that were
causing or likely to
cause death or serious physical harm to employees:
a)Glue area -- the supporting structure used to support a 1/2 ton chain
hoist, which
was used to lift and support a 55 gallon barrel of glue, was not inspected
and load
tested to ensure the structure could support the load(s) applied when
using the
hoist.
Reference:ANSI B30.16-2003, Section 16-1.3: Installation, Paragraph
16-1.3.2
Support:  The supporting structure, including trolleys, monorail, or crane,
shall be designed to withstand the loads and forces imposed by the hoist
for
the rated load.
NOTE:Among other methods, one feasible and acceptable method to correct
this
hazard is to have all supporting structures used with overhead hoists
inspected and load tested to determine the load(s) can be sustained without
damage.

a)Glue area -  the under-the-hook lifting was not marked with the maximum
weight it was load tested to support.
Reference:ANSI B30.20-1985, Chapter 20, Section 20-1.2 Markings and
Construction, Paragraph 20-1.2.1 Markings:  (a) Rated Load Marking.
The rated load of the lifting device shall be marked on the main
structure where it is visible.
NOTE:Among other feasible and acceptable method to correct this hazard is
to
label the under-the-hook lifting device with the required information.ok
