Title 40.1-51.1(a), Code of Virginia: Employer did not furnish employment,
and a place of employment which
were free of recognized hazards that were causing, or likely to cause
death or serious physical harm to
employees in that: Employee was exposed to struck by hazards while cutting
angle iron with acetylene torch, on
the top of a 55 gallon drum containing flammable vapors and liquid. The
heat caused the vapors to expand and
blow the lid off of drum striking employee in the forehead.
a.A foreman was cutting a section of angle iron with an acetylene torch.
The angle Iron was to be used as
a sign post for safety signage.  He was using three 55 gallon drums in the
same manner that one would
use a saw horse. The lid of the container became hot, which caused the
vapor to expand, blowing the
lid off of drum. The employee was struck in the forehead by the lid. He
suffered lacerations to his
forehead requiring as many as 100 stitches to close.
One feasible, and acceptable abatement method among others to correct this
hazard
is for the employer to
implement retraining of all employees regarding existing Hazard
Communication Program, and to comply with
manufacturers warning labels posted on product container which states (a)
ATTENTION!  This container
hazardous when emptied. "Emptied " containers retain vapors and liquid.
All Hazard precautions must
be observed when handling "emptied" containers. Empty drums are not
suitable for use other than as
delivered.  (b) CAUTION! Keep liquid and vapors away from heat, spark, or
flame. Do not cut, grind, or
weld on or near container.
