Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a)Yard: An employee was operating a Hyster forklift moving trusses. The forklift is equipped with seatbelts, however, the employee was not using the equipment. AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD TO CORRECT THE HAZARD IS TO WEAR THE SEATBELT AS REFERENCED IN ASME B56.1-2000 "SAFETY STANDARD FOR LOW LIFT AND HIGH LIFT TRUCKS."
