Labor and Employment Article, Section 5-104(a): The employer did not
furnish employment and
a place of employment which were free from recognized hazards that were
causing or likely to
cause death or serious physical harm to employees:
(a)Date of Violation:05/05/05
Condition:Employees removing temporary traffic control signs from the
shoulder and
median strip of a dual highway with a speed limit of 55 miles per hour
were not protected from being struck by oncoming vehicular traffic.
Among other methods, one feasible and acceptable abatement method to
correct this hazard is
to develop and implement a work rule which would prohibit employees from
crossing the travel
portion of the highway to retrieve signs located in the fast lane or
median strip, and to train
employees in the purpose, use and limitations of the method being used to
decrease the
likelihood of an employee being struck by vehicular traffic.
Abatement documentation (photographs, receipts, copies of programs,
training
certification, etc.) is required for this item.
