Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to crushing, struck by or fall hazards when loading precast
concrete sewer inlet
boxes:
a) Lyons & Hohl, Inc., Honey Brook, PA  -  On August 22, 2006 a delivery
driver fell
off the side of a flatbed truck while standing behind a load which shifted
as the load was
being centered on the truck by the action of a fork (one of two) of a
forklift truck
alternatively pushing on each of two ends of the load in order to center
the load on the
truck.  The load, a precast sewer inlet box supported by four bricks and
sitting on top
of a concrete slab, shifted or jolted as the fork of the forklift truck
pushed at the base of
the concrete slab.  The employee standing behind the load and directing
the forklift
operator fell backwards from the side of the truck in a reaction from the
load movement
and fell to the ground and sustained contusions to the head and shoulder
from which he
died on August 24, 2006.  The practice of using one or both forks of the
forklift truck
to push a load is not part of the operational design of the forklift and
can cause hazards
in several ways, including: (1) compromising the forklift's capacity;(2)
damaging the
fork(s);(3) causing the load, or part of the load to shift or tip; (4)
interfering with the
maneuverability of the forklift; (5) causing the driver less control of
the load.  Observed
08/25/06.
ABATEMENT NOTE: AMONG OTHER METHODS, ONE FEASIBLE AND
ACCEPTABLE METHOD TO CORRECT THIS HAZARD IS TO TRAIN
OPERATORS TO FOLLOW THE MANUFACTURER'S INSTRUCTIONS ON THE
SAFE OPERATION OF THE EQUIPMENT AS SPECIFIED IN THE OPERATORS
MANUAL AND THE AMERICAN NATIONAL STANDARD: ITSDF B56.1-2005:
SAFETY STANDARD FOR LOW LIFT AND HIGH LIFT TRUCKS, SECTIONS
5.4.1(d) and 5.4.3.
