Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not
furnish to each of his employees employment and a place of employment
which were free
from recognized hazards that were causing or likely to cause death or
serious physical harm
to employees in that employees were exposed to struck-by hazards from
approaching traffic.
(a)Rocky Mountain Flagging, Inc., at 5801 N. Federal Blvd., Denver, CO:
On or before July 19, 2005, the exposing employer did not ensure that
flagger
stations were located on the roadway far enough in advance of the work
space
so that approaching road users have sufficient distance to stop before
entering
the work space, in that the flagger station was located directly adjacent
to the
workzone. This condition exposed on-site flaggers and construction workers
to
struck-by hazards from approaching traffic.
Among others, one feasible and acceptable abatement method to correct this
hazard
is
to locate flagger stations sufficiently far enough in advance of the work
space so that
approaching road users are warned of flaggers and will have sufficient
distance to
stop before entering the work space. Guidelines for determining the
distance of the
flagger station in advance of the work space are shown in Table 6E-1, Part
6,
MUTCD 2000. Flagger stations should be preceded by proper advance warning
signs.
At night, flagger stations should be illuminated. Uniformed law
enforcement traffic
officers should be also be used on roadways where traffic is channelled
around work
sites and it is necessary to assure the advisory and regulatory speeds are
being
enforced.
