Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of crushing or falling when trailers were moved away from the dock while dock workers were engaged in loading or unloading cargo: (a)Yellow Freight Systems, Inc., 15950 Smith Road, Aurora, CO: On or about 1/14/2006 and at times prior thereto, dock employees were potentially exposed to trailers being pulled prematurely from the dock while being loaded by a forklift. This hazard exposes employees to falling or crushing injuries. Among other methods, one feasible and acceptable abatement method to correct this hazard is to install a dock-lock devices prior to loading or unloading a trailer at the dock. Abatement Note: Abatement certification and documentation are required for this item (see enclosed "Sample Abatement-Certification Letter").
