Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to an unstable working surface:
(a)T Mack Commercial Construction LLC, at the Fraser Marketplace,
southeast of the intersection of US Highway 40 and Grand County Road
804, Fraser, CO: On 1/28/06, the employer did not ensure that employees
worked from a safe platform held aloft by a rough terrain forklift, in
that one
employee was working at a height of approximately twelve feet above ground
level in a job made platform.  The platform consisted of an unsecured
wooden
pallet and unsecured sheets of particle board resting upon the forks of the
Caterpillar rough terrain forklift.  The employee did not have fall
protection,
nor did the employee utilize a personal fall arrest system.  This condition
exposed the employee to an approximate twelve foot fall hazard.
Abatement Note:  Among other methods, one feasible and acceptable
abatement
method to
correct this hazard is to provide a personnel platform which complies with
the design
requirements of ASME B56.6-2002, The American Society of Mechanical
Engineers, An
American National Standard, "Safety Standard for Rough Terrain Forklift
Trucks".
