Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to hazard of falls:
a)  Mountain K-7, 450 E. 17th Ave., Denver, CO:  The employer had not
ensured that during times when employees of the company were installing
brick
on the west side of the building while working on a Hydro Mobile M2 mast
climber, wore fall protection while climbing on the supporting masts.  On
or
about 1/24/2006, employees accessing the working platform of the mast
climber
were doing so while climbing on the supporting masts without fall
protection.
Condition exposed employees to a fall hazard of approximately 35 feet.
b)  On or about 1/24/2006, employees of the company utilizing a powered
material lift device were doing so while exposed to a fall hazard.
Employees
were observed lifting a vat of mortar onto the working platform of the
Hydro
Mobile M2 mast climber with the guardrail gates open.  No personal fall
arrest
system (PFAS) was used.  Condition exposed employees to a fall hazard of
approximately 35 feet.
Among other methods, one feasible and acceptable abatement method to
correct
this hazard would be to follow the manufacturer's operating manual and
mandate
the use of fall protection when climbing or descending the tower if
exposed to a
height over 10 feet as listed on page 21 of the manual.
