Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to a crushing hazard:
(a)Bedrosians Denver LLC, dba Bedrosians Tile and Marble, at 14155 East
42nd Avenue, Denver, CO: On 6/9/06, Bedrosians Tile and Marble did not
furnish employment and a place of employment which were free from
recognized hazards that were causing or likely to cause death or serious
physical harm to employees in that employees were exposed to a crushing
hazard.  Employees utilized a Caterpillar model GC70K powered industrial
truck to drag bundles of granite slabs out of a trailer.  The slabs were
positioned vertically upon a wooden frame.  A bundle of slabs consisted of
six
to seven slabs, each weighing approximately five hundred pounds.  One
employee was positioned within the trailer to assist while the PIT dragged
the
bundle out of the trailer.  This condition exposed the employee to a
crushing
hazard.
Abatement Note:  A feasible means of abatement may include, but is not
limited to:
(a)Design and fabricate a powered industrial truck attachment that securely
cradles a bundle of slabs.
(b)Institute and enforce a policy in which employees are prohibited from
standing
or putting any portion of their body in the danger zone of slabs.
(c)Conduct employee training of safe slab handling procedures to ensure
they
fully understand the dangers of putting any portion of their body between
slabs
and the trailer wall, and the safe methods of maneuvering slabs.
