Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to caught-between and struck-by hazards: a)Shadow Builders, Inc. & 3450 Shallow Pond Drive in Fort Collins, CO: The exposing employer did not ensure the elevated working platform was securely attached to the lifting carriage or the forks of the rough terrain forklift. This condition exposed employees to falls from elevation. Among other methods, one feasible and acceptable abatement method to correct this hazard is to perform the following: ASME B56.6-1992, American Society of Mechanical Engineers, Section 5.15.1(b) "Be certain that the platform is securely attached to the lifting carriage or forks". Note: The ASME B56.5-1992 Section 5.15.1(b) standard can be obtained by contacting the American Society of Mechanical Engineers, 345 East 47th Street, New York, NY 10017. Abatement Note: Abatement certification is not required for this item.

Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to caught-between and struck-by hazards: a)Shadow Builders, Inc. & 3450 Shallow Pond Drive in Fort Collins, CO: The exposing employer did not ensure the operator was in position to control the rough terrain forklift when the platform was not equipped with controls. This condition exposed employees to falls from elevation. Among other methods, one feasible and acceptable abatement method to correct this hazard is to perform the following: ASME B56.6-1992, American Society of Mechanical Engineers, Section 5.15.1(s) "A trained operator shall be in position to control the rough terrain forklift truck or available to operate controls if the platform is not equipped with controls. When the operator is not in the operating position, block the truck wheels and apply the parking brake with all travel controls in neutral.". Note: The ASME B56.5-1992 Section 5.15.1(s) standard can be obtained by contacting the American Society of Mechanical Engineers, 345 East 47th Street, New York, NY 10017. Abatement Note: Abatement certification is required for this item (See enclosed "Sample Abatement-Certification Letter").
