Section 5(a)(1) of the Occupational safety and Health Act of 1970: the employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: a. On or about September 9, 2005, at a jobsite located at 996 Brook Forest Avenue, Shorewood, Illinois, employees were exposed to the hazard of being struck by a load during the use of a job made scaffold box attached to the forks of a Terex, rough terrain forklift truck, while performing carpentry work. One feasible and acceptable abatement method, among others, to correct this hazard would be to follow the American National Standards Institute (ASME B56.6-2002) Safety Standard for Rough Terrain Forklift Trucks, which states... "Do not allow anyone to stand or pass under the elevated portion of any rough terrain forklift truck, whether empty or loaded."
