Section 5(a)(1) of the Occupational safety and Health Act of 1970: the employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: a. On or about January 27, 2006, at the above addressed jobsite, an employee was performing masonry operations from the forks of a BOBCAT, Skid Steer Loader, the employee was thereby expsoed to injuries from falls created by the improper use of the Skid Steer Loader. One feasible and acceptable abatement method includes, but are not limited to the following: a. Follow the Equipment Manufactures Institute (EMI) statey manual for operator and mechanics of Skid Steer Loader which states, " Never use the bucket for a work platform or personnel carrier."
