Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards: (a)Jobsite, Walnut Hill Shopping Plaza, Uniontown, PA: On or about 6/21/05 employees were observed riding in a boom-supported elevating work platform (JLG) without wearing any fall protection. The employees were using the lift to access/exit the roof. The fall hazard from the roof to the ground is approximately 24'6". Among other methods, one feasible and acceptable abatement method to correct this hazard is to ensure the employees wear personal fall arrest equipment when riding in the boom-supported elevating work platform.
