Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to hand and finger amputation injuries: (a) Mon Valley Recycling warehouse area, 5 ton Shear: On or about 05/05/06 employees were operating the shear, cutting metal piping and they were activating the controls by using foot pedals that were not guarded to prevent accidental activation of the controls thus exposing workers to amputation injuries. (b) Mon Valley Recycling Center warehouse, 2 ton Shear: On or about 05/05/06 employees were utilizing the foot pedals to activate the controls and the foot pedals were not guarded to prevent accidental activation of the controls which exposed workers to amputation injuries. Among other methods, one feasible and acceptable means of abatement is to enclose the foot pedals with guards.
